These rules govern the "AMMY's" (the Awards). Before entering, each entrant must review and be subject to The Awards Rules. No purchase is necessary to enter. The act of entering constitutes acceptance of the Rules. The Rules may be found at www.xtube.com/ammys/rules.php.

The Awards are open to:

• The general public over the age of 18,
• All members of XTube.com

The Awards are NOT open to:

• XTube Studio & Webmaster Account holders,
• EXXXOTICA ~ Miami Beach and XTUBE.COM employees, contractors, immediate families of and anyone living with any employee or contractor of the Awards Sponsor or it's, or their, corporate affiliates, advertising or promotional agencies or affiliates,
• Persons who have appeared in adult entertainment for which you were paid a sum of money, Except XTube Amateurs,
• Persons who direct, produce, write or otherwise participate in the creation, maintenance or management of adult entertainment for which they are paid.

The Awards period runs from 10:00 a.m., Monday, September 24, 2007 to 11:59 p.m., Tuesday, April 1st, 2008 (the "Contest Period").

During The Awards Period submit your video online HERE.
Your video must meet the following criteria in order to be eligible to win:

• The video must be your own original work.
• The video must:
  • be less than 50MB in size;
  • be in full compliance with the XTube terms of use;
• The video must not:
  • contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights,
  • have been submitted previously in a contest of any kind; and
  • contain any:
    • Persons under the age of 18 years;
    • Gratuitous violence;
    • Dangerous stunts;
    • Real weapons of any kind, including, but not limited to, guns, knives or projectiles;
    • Drugs or drug use;
    • Material that is hateful, tortuous, defamatory, slanderous or libelous;
    • Material that promotes pedophilia, bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other bias;
    • Material that is unlawful, in violation of or contrary to the laws or regulations in the province of Ontario or country of Canada; or
    • Material that in The Awards Presenters' sole discretion, is inappropriate or not acceptable in any way.

No entries will be permitted after the deadline. The Awards Judges will vote on the best videos. The voting period is the duration of the Contest Period. The odds of winning depends on the number of eligible entries received.

The videos that receive the most number of unique votes in each category win.

A Contest Sponsor representative will contact the winners on Tuesday, April 1st, 2008 via the contact information recorded on their entry, during regular business hours (EST). In order to be eligible to win, the potential winner must reply within 72 hours to maintain their eligibility. All winning videos will be available for viewing on http://h01.xtube.com/ammys/.

There are a total of five (5) prizes in each category (Female: Best Soloist - Male; Best Soloist - Female; Best Blow Job; Best Rug Munch; Hottest Couple; Worst Lighting; Video of the Year: Lifetime Achievement Award: Paris H., Kim K., Pam & Tommy, Screech). The winner of each category will receive::

• An AMMY Award (Priceless)
• Brand New Digital Video Camera (Valued at approximately $500 USD)
• 2 VIP Tickets to EXXXOTICA 2008 (Valued at approximately $220 USD)
• $250 XTube Dollars (Valued at $250 USD)
• Bragging Rights (Priceless)

The winners will receive a letter from The Awards Presentors, including information on how to redeem his/her Prize. If the winner does not claim the Prize within 30 days of November 2, 2007, for any reason, an alternate winner will be selected by The Awards Judges and the initial winner will have no further claim to the Prize. The Awards Sponsors may, but are not obligated to mail or courier prizes, and are not responsible for unclaimed prizes.

We will use personal contact information to administer The Awards. Information you submit is stored offline and is not retransmitted shared or otherwise put into unnecessary jeopardy.

The Awards Presenters may, at their sole discretion, prohibit any person from entering any contest whom they believe to be abusing The Awards Rules. Such abuse includes but is not limited to entering false information and entering more than one entry.

All Contest entrants release and indemnify The Awards Presenters and their respective parent(s), subsidiaries, affiliates and/or related companies and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buying and promotional agencies from any liability in connection with The Awards. Prior to receiving the Prize, the winners will be required to show valid photo ID, must sign a declaration of eligibility and compliance with The Awards Rules. The winners will be required to sign a release and consent to publicity form, releasing and indemnifying The Awards Sponsors and their respective parent(s), subsidiaries, affiliates and/or related companies and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buying and promotional agencies from any liability in connection with The Awards and/or the Prize. Prior to receiving the Prize, each winner shall agree to have the winner's name, city of residence, photograph, voice and/or image used in any and all forms of media and publicity, without further compensation by The Awards Presenters and/or their advertising and promotional agencies. The Prize winners shall each agree to have the winner's video posted on www.XTube.com, www.eXXXotica.com and www.theAmmyAwards.com for viewing by the general public. If The Awards Presenters do not receive the signed release and form(s), as contemplated herein, back within 48 hours, then The Awards Presenters may draw for another potential winner and the first winner will have no further claim to the prize.

The Awards Presenters reserve the right at their sole discretion to cancel, suspend or modify The Awards or The Awards Rules at any time without notice. All prizes must be accepted as awarded and are non-transferable. The Awards Presenter are not liable for any errors or negligence that may arise in connection with this Contest or the Prizes. The Presenters reserve the right to substitute any Prize with a prize of equal or greater value. The winners must be willing to accept the Prize delivery upon Contest Presenter's terms and delivery times. The Awards Presenters is not responsible for lost or misdirected or late or ineligible entries.

Contest Presenters are not responsible for any entries that are lost, misdirected, incomplete or illegible, or for the inability to process entries, or any errors, damage or negligence that may arise in connection with The Awards, including failed, partial or garbled computer transmissions, or for technical failures of any kind including, but not limited to, malfunctioning of any network, hardware or software, human error, or property damage which may limit an entrant's ability to participate in The Awards. Proof of sending will not be proof of receipt by Contest Presenters. The Awards Presenters is not responsible for any on-line or other charges that may be incurred in connection with participating in The Awards. The Awards Presenters are not responsible for the availability or content of any other website to which the websites referred to in these Contest Rules are linked (the "Websites"). Contest Presenters make no representations or warranties and there are no conditions of any kind, express or implied, statutory or otherwise, with respect to the Websites, including without limitation, that the Websites will meet entrant's requirements, always be available, accessible, accurate or secure. The Awards Presenters will not be liable for any damages of any kind including without limitation direct, indirect, incidental, punitive and consequential damages arising out of or in connection with participation in The Awards, the use of the Websites, or downloading any materials in this Contest. Use of any method, mechanism, device, or software affecting the proper functioning of The Awards or the Websites is strictly prohibited. The Awards Presenters may, at their sole discretion and without notice, terminate the right of any person to participate in The Awards or use the Websites, including the disqualification of any individual who tampers with the entry process.

Any attempt by an entrant to deliberately damage any website or other components or undermine the legitimate operation of The Awards is a violation of criminal and civil laws and should such an attempt be made, The Awards Presenters reserve the right to seek damages from any such entrant to the fullest extent permitted by law.

This Contest is governed by and subject to the laws of Ontario and Canada By participating in this Contest, entrants agree to be bound by these Contest Rules and the decisions of the Judges in awarding the Prizes, which decisions shall be final and binding upon all entrants. Failure to comply with these Contest Rules may void the entrant's rights to any Prize.
